Rip Torn's burglary case -- which was supposed to go before a judge today but didn't -- may not stick ... ironically, because of alcohol.
Rip was arrested last month after cops found him inside a bank with a loaded gun. But today, Rip's lawyer, Tom Waterfall, told TMZ Rip has what may be an airtight defense -- he thought he was in his Connecticut home (left) and not in a bank (right).
So, you say, the house is green and the bank is yellow. Not when you've been drinking. You say the house appears smaller than the bank. Not when you've been drinking. And, Waterfall says, the bank was once a house.
Short story ... an old man comes home in the dark after a night of drinking, the keys don't unlock the door so he breaks the window, enters, and goes to sleep. When the cops arrive Torn even asks why they came to his home. So good luck to prosecutors who try to prove Rip had an intent to steal.
As for the firearms charges ... that's a toughie. Rip's in rehab and Waterfall hopes he can convince the judge to go easy.

Kid Cudi has finally apologized to the guy he allegedly socked at a concert last year -- and blamed the whole thing on too much drinky drinky, this according to the self-proclaimed punchee.
Michael Sharpe -- the man who claims Cudi's fist connected with his face during a December show in Vancouver -- tells TMZ the rapper called him up last weekend to finally apologize, and blamed the knuckle sandwich on the a-a-a-a-a-alcohol.
Sharpe said Cudi also offered to fly him out to New York for an all-expenses paid weekend -- but so far, nothing is set in stone.
We reached out to Kid Cudi for comment -- so far, radio silence.

Rip Torn is so in need of help, even the CEO of the bank he allegedly broke into on Friday night wants to see someone stage an intervention.
Torn was arrested after cops found him drunk inside a bank in Connecticut with a loaded revolver.
Mark E. Macomber, President/CEO of Litchfield Bancorp in Connecticut, tells TMZ no one was in the building at the time Torn allegedly broke in -- and the only damage was to the smashed window cops say was Torn's point of entry.
Macomber says he didn't believe Torn was trying to hurt anyone or steal anything. Macomber spoke to authorities in Connecticut who told him Torn was found lying on the floor. He said cops believe Torn thought he was in his own house.
He called the incident a "serious matter," but seemed to think Torn needed help with his alcohol problem more than anything else.
Torn was charged with carrying a pistol without a permit, carrying a firearm while intoxicated, first-degree burglary, first-degree criminal trespass and third-degree criminal mischief. He is due in court on Monday.
UPDATE: As of Sunday morning, Rip Torn is still in custody.

Rip Torn was arrested Friday night for allegedly breaking into a bank while drunk and armed with a loaded revolver.
State police responded to an alarm at the Litchfield Bancorp building in Salisbury, CT at 9:40 PM last night. Police say they found Torn "with a loaded revolver" and he was "highly intoxicated."
Law enforcement sources tell us Torn gained access through a broken window, which they believe Torn broke himself.
Torn was taken to the Troop B barracks in North Canaan and is being held on $100,000 bond.
Cops say Torn was charged with carrying a pistol without a permit, carrying a firearm while intoxicated, first-degree burglary, first-degree criminal trespass and third-degree criminal mischief.
According to the Register Citizen, he is scheduled to appear in court on February 1.
Rip has had previous alcohol-related arrests -- one of which yielded the greatest mug shot in the history of mankind.

According to Amy Winehouse, the real reason behind her Christmastime assault of a theater manager was too much Coke ... as in, Coca-Cola mixed with vodka.
Amy fixed up her beehive, dyed her skin orange, put on some clean clothes and showed up to court this morning -- where she pled guilty to assaulting manager Richard Pound during a showing of "Cinderella."
Wino admitted she had already downed five vodka & Coke's before Pound suggested she have a water -- a suggestion she reacted to by pulling his hair and cussing him out.
Wino avoided jail time, but was placed on two-year conditional discharge and ordered to pay Pound $300.

Table flipping Teresa Giudice from "Real Housewives of New Jersey" just got one-upped by her husband -- because he flipped an entire pickup truck.
We obtained this shocking photo of Giuseppe "Joe" Giudice's completely demolished vehicle -- taken after cops say he struck a pole early Thursday morning in Montville, NJ.
As we previously reported, Giudice was taken to the hospital after the accident ... where he was charged with driving while intoxicated, reckless driving, careless driving, and failure to maintain a traffic lane.

Mariah Carey appeared to have some trouble walking to the stage at last night's People's Choice Awards -- but this time, should she blame it on the a-a-a-a-a-alcohol ... or that extremely tight dress?
Just one night before, Mariah was admittedly hammered on stage at an awards show in Palm Springs -- where she slurred and stumbled through her speech.

Mariah Carey was busted for BUI in Palm Springs last night -- babbling under the influence -- as she made a drunken mess out of herself while trying to give an acceptance speech at an awards show.
At last night's Palm Springs Film Festival, Mimi took home the prize for Breakthrough Actress for her role in "Precious" -- but when she attempted to talk, she was anything but.

Bow Wow clearly has something in common with Chris Brown -- they both commit crimes behind the wheel.
The Artist Formerly Known as Lil' Bow Wow, who partied with Brown and Akon last night at LIV nightclub at the Fontainebleau in Miami, posted a message to his Twitter page just past midnight that read, "Face numb im whippin the lambo. Tispy as f*k. Just left @livmiami."
A few minutes later, Mr. Wow wrote, "Im f**ked up!!! Ohhhh damn. Y i drive the lambo. Chris might have to drive after next spot."
BTW, the tweet isn't enough for cops to make an arrest.
UPDATE -- Bow Wow has since taken down the aforementioned tweets and apologized, saying, "Apologize for that tweet. it was stupid and immature. not a way i want to kick my #2010 year off. i got too much good stuff lined up. my bad."

The Florida Highway Patrol wanted to get a blood test from Tiger Woods after the crash, because a witness told them Tiger was boozing earlier in the day -- this according to new documents obtained by TMZ.
FHP had requested Tiger's blood sample, after a witness -- we're told his wife -- "stated that the driver had consumed alcohol earlier in the day and the same witness removed the driver from the vehicle after the collision."
The document continues, "The same witness stated that the driver was prescribed medication (Ambien and Vicatin [sic]}."
As we first reported, it was Elin Nordegren who pulled Tiger from the crash and told cops he had taken medicine (but she didn't know when) and even brought the pill bottles to the EMTs.
The document concludes, "Impairment of the driver is also suspected due to the careless driving that resulted in the traffic crash."
Ultimately, the FHP's request for the blood sample was denied, on grounds of insufficient evidence to issue a subpoena.
The FHP has determined alcohol was not a factor.

TMZ has learned an ambulance was called to the home of David Hasselhoff on Friday -- and this video might give us a glimpse as to why.
The Hoff -- who has been battling problems with alcohol for years -- arrived at LAX on Wednesday looking ... well, like he enjoyed the flight. His driver got into it with the freelance photog who took the video -- but The Hoff just kept grinning and saying, "It's all good."
Just two days later, an ambulance was called to his home and someone -- local fire department wouldn't confirm who -- was transported to the hospital. Coincidence?
We reached out to David's people -- never heard back.
